Expired Green Card

Question:

Our client has an expired green card as of September 2023, and their application is dated June of 2024.  He states that his paperwork is up to date with the USCIS but that it may take up to a year to receive his updated card.  Will the agencies allow an expired green card?

Answer:

USCIS announced a green card extension in January 2023. Note that this extension is for 48 months! You can follow the guidance given in this announcement and get the appropriate notices the borrower received, so you have that to back it up. I would make sure your lender allows this because each investor may have overlays on these types of situations, but I have not had any issues with using this in a file and getting what is requested. The borrower can also go online with USCIS to see that their green card is still active and print that page for you.
